Service Use Policy

Purpose

This Service Use Policy (SUP) defines acceptable practices relating to the use of OpenMarket services by customers of OpenMarket. By using the services, you acknowledge that you and your users are responsible for compliance with the SUP.  The SUP is designed to protect the OpenMarket Network and services, and OpenMarket customers, from improper and/or illegal activity.

Prohibited Use

OpenMarket services may be used only for lawful purposes and may not be used for any illegal, improper or abusive activities.  Transmission or distribution of any material in violation of any applicable law or regulation is prohibited.  This includes, without limitation, the use or transmission of any data or material protected by copyright, trademark, trade secret, patent or other intellectual property right without proper authorization and the transmission of any material that constitutes an illegal threat, violates export control laws, is obscene, defamatory or otherwise unlawful.

System and Network Security

Customer shall not violate the OpenMarket Network, the OpenMarket Systems, or the Operator Network(s), or their respective security measures, and any such violations may result in criminal and civil liability.  Customer shall not attempt to gain unauthorized access to or use of any of OpenMarket’s or an Operator’s data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures, without express written authorization of OpenMarket.

SPAM

OpenMarket has a zero tolerance policy on SPAM, junk-messages or unsolicited messages (UM), and such messages are explicitly prohibited.  Spam, junk-messages and UM are defined as: the sending of the same, or substantially similar, unsolicited SMS messages, to more than one recipient.

Content

Engaging in activities or, uploading, downloading, submitting, transmitting, distributing or facilitating the distribution of, any information that contains “inappropriate content” in connection with the OpenMarket services.  Inappropriate content includes, but is not limited to, content that:

  • May be considered libelous, slanderous, defamatory, threatening, sexually explicit, vulgar, profane, obscene, offensive, abusive, malicious or otherwise harmful to any person or entity, constitutes or promotes “hate speech” or is otherwise discriminatory based on race, sex, creed, religion, nationality, disability, sexual orientation, language, or age.
  • Is fraudulent, deceptive, inaccurate or misleading.
